I am not married and not African-American. I was arrested for allegedly pointing a firearm at my next door neighbor. In truth, however, I was trying to scare away a drug addict who was using on his front steps and blowing dope smoke into my window. Although I did tell the person I had a firearm, I never produced it and he had his back to me the whole time. Nevertheless, because a firearm was involved, I pleaded guilty to avoid a possible three-year mandatory prison sentence. I did spend a couple of days in jail which I did not enjoy. I also pleaded guilty to a later DUI. This was a consequence of my driving on a flat tire in an attempt to avoid a road-enraged driver who had threatened my safety and thrown something at my vehicle. I was finally able to safely pull over and was in the process of calling AAA when I was arrested for suspected DUI. My public defender was less than adequate and again, I pleaded guilty in order to avoid a possible one year jail sentence. In jail, we had 15 people in a 9’ x 9’ room with one toilet. We were locked in the cell 23 hours per day and had to sleep on a bare floor. These conditions have been repeatedly held to violate the 8th amendment prohibition against cruel and unusual punishment, as well as 42 U.S.C. Section 1983, for what it’s worth.
